1 Who we are and what this covers

Neexaa (“Neexaa”, “we”) provides a platform at neexaa.com for creating and running websites and online shops. These terms apply to everyone who creates an account or uses the platform, whether as a site owner, a member of a site's team, or a visitor of a site built on Neexaa.

By creating an account or using a site built on Neexaa you agree to these terms. If you do not agree, do not use the platform.

2 Your account

• You must give a real email address and keep it current; it is how we reach you and how you recover your account.
• You are responsible for everything done with your account and for keeping your password secret. Turn on two-step sign-in in your account for extra protection.
• One person may hold one account. Team members must use their own accounts, invited from the Team screen.
• You must be at least 18, or use the platform under the supervision of someone who is.

3 Your site and content

You own the content you publish: text, pictures, files, products and everything else. We do not claim rights over it. You give us the permission needed to store it, back it up, serve it to visitors, resize pictures and send it in emails you asked for, and nothing more.

You are responsible for your content and for having the right to use it. Do not publish or sell anything that is illegal in Kuwait or where your visitors are, that infringes someone's rights, that is misleading, or that harms people. Do not use the platform to send unsolicited email, to host malware, or to collect personal data you have no right to.

We may hide or remove content, or unpublish a site, when we believe it breaks these terms or the law, or when we are legally required to. Where we can, we tell the owner first and give them a chance to fix it.

4 Shops, orders and payments

When you sell through a shop on Neexaa, the sale is between you and your customer. You are the seller: you set prices, describe products honestly, deliver what was ordered, handle returns and refunds, and comply with consumer and tax rules that apply to you. Neexaa is not a party to the sale.

Online payments are collected through our payment partners (SWAP Payments and, where offered, PayPal) and settled to you under the terms we agree with you separately. Fees, settlement timing and chargebacks follow those terms. Cash-on-delivery and bank-transfer orders are entirely between you and your customer.

Digital products are delivered as files kept private until an order is paid. You must have the right to sell every file you upload.

5 Plans, fees and renewals

• The Free plan costs nothing. Paid plans are priced per month or per year as shown on the Upgrade screen, in US dollars, and are paid in advance.
• A paid plan runs for its period. It renews by itself only if you chose to save a card for automatic renewal, in which case we charge that card three days before the period ends and email you a receipt; you can switch this off or remove the card at any time. Otherwise we remind you before it ends. If nothing is paid, your site stays online and your content stays intact, and new additions follow the Free plan's limits until you renew.
• Fees are not refunded for unused time, except where the law requires it or where we choose to. Ask within seven days of a payment if something went wrong and we will look at it.
• We may change prices or plan limits; changes apply from your next payment, and we tell you in advance by email.

6 Domains

You may connect a domain you own. You keep all rights to it and remain responsible for its registration and renewal. We issue and renew the certificate for it while it points at Neexaa. We may refuse or disconnect a domain that infringes someone's rights or is used against these terms.

7 Our service

We work to keep the platform available, secure and fast, and we back it up daily, but we do not promise uninterrupted service. We may change, add or retire features, and we announce meaningful changes on the platform or by email.

The platform is provided as it is. To the extent the law allows, we are not liable for indirect losses, lost profits or lost data beyond what our backups can restore, and our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim.

8 Ending

You can stop using the platform at any time; unpublish your site or ask us to delete your account and its sites. We can suspend or close an account that breaks these terms, does not pay for a paid plan it uses, or has been inactive with no site for a long time, with notice by email where possible.

You can delete your account yourself from the Account screen: the sites only you own go offline at once, and thirty days later the account is closed and those sites are taken out of service. Signing in during the thirty days cancels it. Export your content first if you want a copy; every site's Settings screen has an Export button.

9 Changes and contact

We may update these terms. The date at the top is the version in force; material changes are announced by email or on the dashboard, and continuing to use the platform after that means you accept them. Questions go to hello@neexaa.com or the Support page.

These terms are governed by the laws of the State of Kuwait, and its courts have jurisdiction over any dispute.
